"To the Honorable William Leigh Judge of the Circuit Superior Court of Mecklenburg - your orators, Ambrose Lett, Matthew H. Lett and Richard Malone and oratrix Lucy Lett Malone who was Lucy Lett - Humbly complaining (?)hen unto your Honor - That a number of years ago a certain former James Lett of the County departed this life, having just made and published his last Will and Testament, which is prayed to be taken as a part of this Bill - in which Will he desires that his just debts be first paid - and for that purpose he requested his land to be sold - and the balance of the money (after the payment of his debts) to be applied to the buying of land for the support of his wife and children James Lett, Matthew H. Lett, Sally Lett, Ambrose Lett and Lucy Lett - the Testator also directed that three slaves, Bille, Silva and Fed should be loaned for the support of his wife - and also that one yoke of oxen & eleven head of sheep should be sold for the support of the above named individuals - upon the death or marriage of his widow the aforesaid land to be sold & the money to be equally divided between the aforesaid James Lett, Matthew H. Lett, Sally Lett, Ambrose Lett and Lucy Lett - the said Negroes also with their increase upon the happening of either event the death or marriage of his widow to be sold & the money to be equally divided among the aforesaid children; & also all the stock of Horses, Cattle & Hogs, household and kitchen furniture and plantation utensils to be sold and the money to be equally divided between the said children - Your orators and oratrix will here state to your Honor that a certain John Hubbard qualified as executor of the said James Lett - That an Inventory of the estate of said Lett was returned and admitted to Record of the Court of Mecklenburg County - which is also prayed to be taken as a part of this bill - but no account of Sales or account current has ever been returned by the said executor of the said estate which he was bound to have done - That the executor Hubbard did sell the Lands of his Testator to a certain John T. (?) Allen for the sum of two hundred and fifty pounds - & therefore is bound to account for the same - That there were few or no debts due from his Testator - as an evidence of it, there were seventy five pounds in specie in the House at the time of his death. That one said Richard Malone intermarried with Lucy daughter of the said James Lett - that James Lett and Sally Lett whose names are mentioned in the Will of said James are dead leaving no children - that the widow of said James Lett is dead - That the said executor John Hubbard having made and published his last Will and Testament - which is also prayed to be taken as a part of this Bill - in which he appoints his son Ralph Hubbard his executor - who took upon himself the burden of the execution thereof - Now may it please your Honor there has been great mismanagement of the estate of the said James Lett, by his executor John Hubbard - Why did he the executor not render an account of sales - Why did he not render his administration account? - In tender consideration whereof and for as much as your orators and oratrix are without remedy in the premises, except in this Court - With and therefore that justice may become, they pray that the said Ralph Hubbard executor of John Hubbard who was executor of James Lett, Thomas Smith, John W. Smith, William W. Nolley, Sally G. his wife, who was Sally G. Smith, Robert W. Smith, Christiana Smith & Paulina Smith; Sterling Smith and William Drumwright may be made defendants hereto, & be compelled to answer the foregoing allegation - that Ralph Hubbard settle the administration account of John Hubbard of the estate of James Lett before one of the commissioners of this Court - and that this Court will proceed to decree to each of the complainants, Ambrose Lett, Matthew Hubbard Lett, Richard Malone and Lucy his wife who was formerly Lucy Lett such estate or money to which they may be entitled under the Will of James Lett - that Ralph Hubbard executor of John Hubbard who was executor of James Lett be bound to account for the amount of the appraised value of the estate of the said James Lett which is upwards of three hundred pounds - that Ralph Hubbard executor of John Hubbard who was executor of James Lett be bound to account for like amount of the value of the Land of James Lett which is two hundred and fifty pounds - and your Honor will grant to your orator & oratrix such other & further relief as ? your honor may seem just and equitable - and your orators & oratrix as in duty bound will ever pray &c."
